By accessing or using LandWise ("the Service"), operated at uselandwise.com, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.
Service Description
LandWise provides AI-powered land buildability analysis for parcels in Tennessee. Our service analyzes parcels using spatial data — including flood zones, wetlands, slope, soils, road access, and zoning — and generates AI-powered reports to help users evaluate land suitability for development.
Important Disclaimers
Reports are for informational purposes only.
LandWise reports are not substitutes for professional land surveys, engineering assessments, environmental studies, legal opinions, or any other professional evaluation. Our analyses rely on publicly available spatial data from third-party government sources and AI-generated interpretations, which may contain errors, be outdated, or be incomplete.
You should always consult qualified professionals (surveyors, engineers, attorneys, environmental consultants) before making land purchase or development decisions. LandWise does not guarantee the accuracy, completeness, or fitness of any report for any particular purpose.
Account Responsibilities
You are responsible for maintaining the security of your account credentials managed through Clerk. You agree to provide accurate information and to notify us promptly of any unauthorized use of your account.
Payment Terms
Certain features of the Service require payment. Payments are processed securely through Stripe. All purchases are final, though refund requests may be considered on a case-by-case basis at our discretion. Pro subscriptions may be cancelled at any time, with access continuing through the end of the paid billing period. If the Service fails to deliver a report due to a technical error, we will re-run the report or issue a refund. For full details, see our Refund Policy.
Fair Use Policy (Pro Subscription)
Pro subscriptions include up to 200 new parcel analyses per billing period under our fair use policy. Re-accessing previously analyzed parcels does not count toward this limit and is always free.

Intellectual Property
The Service, including its design, code, and branding, is owned by LandWise. Reports generated for you are licensed for your personal or business use. You may not resell, redistribute, or publicly publish reports without our written permission.
Data Accuracy
Spatial data used in our analyses is sourced from third-party government APIs (FEMA, USGS, NRCS, state and county GIS systems). We do not control or guarantee the accuracy, currency, or completeness of this data. Data may not reflect recent changes to parcels, zoning, flood maps, or other conditions.
Limitation of Liability
To the maximum extent permitted by law, LandWise and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising from your use of the Service or reliance on any report or analysis provided. Our total liability for any claim shall not exceed the amount you paid for the specific report giving rise to the claim.
Termination
We reserve the right to suspend or terminate your access to the Service at any time for violation of these terms or for any other reason at our discretion. You may close your account at any time by contacting us.
Dispute Resolution
Informal Resolution First
Before filing any formal claim, you agree to contact us at support@uselandwise.com and attempt to resolve the dispute informally for at least 30 days. Most concerns can be resolved quickly through direct communication.
Binding Arbitration
If we cannot resolve a dispute informally, any claim arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered under the American Arbitration Association (AAA) Consumer Arbitration Rules. Arbitration for claims under $10,000 shall be conducted in Tennessee. Each party shall bear its own costs and attorney fees unless the arbitrator determines otherwise.
Small Claims Court
As an alternative to arbitration, either party may bring a qualifying claim in small claims court in Tennessee.
Class Action Waiver
You agree that any dispute resolution proceedings will be conducted only on an individual basis and not as a class, consolidated, or representative action. You waive the right to participate in class actions or class-wide arbitrations. You may opt out of this arbitration agreement within 30 days of creating your account by emailing support@uselandwise.com with the subject line "Arbitration Opt-Out."
Governing Law & Venue
These Terms shall be governed by and construed in accordance with the laws of the State of Tennessee, without regard to its conflict of law provisions. Any disputes not subject to arbitration shall be resolved in the courts of Tennessee.
Changes to Terms
We may revise these Terms at any time by updating this page. Continued use of the Service after changes constitutes acceptance of the revised terms.
